Article 2. Definitions

The following terms shall have the following definitions:

  • Association Route Jacques Cœur” or “the Association”: refers to the Association Route Jacques Cœur, telephone number 07 80 76 14 13; whose registered office is located at Place Simone Veil 18000 Bourges.
  • Tickets”: refers to all tickets sold to Customers and included in the Services.
  • GTC”: means the present general terms and conditions of use and sale governing the sale of Tickets from the Internet Site.
  • Customer(s)”: refers to any natural person, capable of contracting, placing a Ticket order via the Internet Site and acting for purposes that do not fall within the scope of his/her commercial, industrial, artisanal, liberal or agricultural activity within the meaning of the preliminary article of the French Consumer Code.
  • Order”: refers to any purchase of a Ticket made by a Customer on the Internet Site from the services of the Association Route Jacques Cœur.
  • Cookie(s)”: refers to a small computer file, a tracer, deposited and read, for example, when an Internet Site is consulted.
  • Day”: refers to a calendar day.
  • Participants”: refers to any individual in possession of a Ticket (purchased by him or her or by a third-party Customer) who participates in a Service.
  • Parties”: refers to the Association and/or the Customer.
  • Partners”: refers to all partners belonging to the Route Jacques Cœur Association.
  • Service(s)” or “Service(s)”: refers to tickets sold by the Route Jacques Cœur Association on behalf of Members of the Association.
  • Members”: refers to all members of the Route Jacques Cœur Association, whose Tickets sold on the Route Jacques Cœur website allow access to certain events or visits.
  • Website”: refers to the website accessible via the following link: https: //route-jacques-coeur.com/ owned and operated by the Association Route Jacques Cœur.

Article 3. Application of the general terms and conditions of service

The placing of an Order via the https://route-jacques-coeur.com/ website implies the Customer’s full and unreserved acceptance of these General Terms and Conditions to the exclusion of any other document.

Unless formally accepted in writing by the Association Route Jacques Cœur, no special conditions may take precedence over the GCS. In the absence of express acceptance by the Customer, any condition to the contrary will be unenforceable against the Association Route Jacques Cœur.

The fact that the Association Route Jacques Cœur does not take advantage of any of the present GTC at a given moment cannot be interpreted as a renunciation to take advantage of any of the said conditions at a later date.

The Association Route Jacques Cœur reserves the right to modify its GCS at any time. It is the Customer’s responsibility to inform himself/herself of the new provisions by consulting the GTC on the Website. Orders are subject to the GCS in force at the time the Order is validated, unless otherwise stipulated by mandatory provisions or public policy.

The GCS can be consulted on request or on the Internet Site.

Article 4. Order modalities

The Site offers several types of Ticket which may be ordered online:

  • Privilege Pass Tickets ;
  • Tickets for year-round admission to certain members;
  • Tickets giving access to temporary events.

These Services are detailed in article 7.

In order to order a Service, the Customer may make a reservation directly without creating an Account.

The Customer goes to the “Ticketing” page, and chooses a ticket from among all those offered on the Website by clicking on the “Book” button.

How to order online – All orders placed on the Website involve the following steps:

  • STEP 1 – Select the Ticket by clicking on the “Book” button.
  • STEP 2 – Select the day you wish to use the Ticket from the calendar. For the Privilege Pass, the customer does not need to select a day on a calendar. The Pass is valid for one year from the date of purchase.
  • STEP 3 – Select the quantity of Ticket required and press the “ADD TO BASKET” button.
    It is the customer’s responsibility to check that the Order corresponds to his or her expectations in terms of the designation and price of the Service selected. The Association Route Jacques Cœur cannot be held responsible for any errors made by the Customer.

At this stage, the Customer may modify the Order by cancelling it using the “x” button on the form displayed.

This step will be validated by clicking on the “ADD TO CART” button.

  • STEP 4 – Personal information on the Ticket. The Customer is invited to enter Personal Data (Surname, First Name, Title, Telephone number, Email address, Town, Postcode), which will be processed by the Association Route Jacques Cœur, in accordance with the conditions set out in the Personal Data section and in the Association Route Jacques Cœur’s Privacy Policy, which can be accessed via the useful links on the website.
    At this stage, customers are invited to check the information they have entered (Ticket type, quantity, day of use, price displayed), as this will be displayed on the Ticket. The customer then clicks on “ADD TO CART”.

The customer can click on “CONTINUE MY PURCHASE” to go back. To access the shopping basket, the customer must place a new order and click on “PASS MY ORDER”. Alternatively, the customer may click directly on “PASS MY ORDER” to finalize the purchase.

The customer will have access to his/her shopping basket, and is responsible for the Tickets in the “Your order” block. The Order summary appears on a new page and includes all the characteristics of the Service, and the price (excluding VAT and including VAT). If the customer wishes to delete Tickets from his Order, he can click on the trash can icon next to each line.

This step is confirmed by clicking on the “CONTINUE” button.

  • STEP 5 – Personal information required to complete the Order. The Customer is invited to enter Personal Data (title, surname, first name, address, zip code, town, country, telephone number, e-mail address), which will be processed by the Association Route Jacques Cœur, in accordance with the conditions set out in the Personal Data section and in the Association Route Jacques Cœur’s Privacy Policy, which can be accessed via the useful links on the website.
    At this stage, the Customer must accept the General Terms and Conditions of Sale of the Association Route Jacques Cœur by electronically ticking the box “By ticking this box, I acknowledge that I have read the General Terms and Conditions of Sale of RJC – ROUTE JACQUES CŒUR”. The Customer must tick this box in order to order the Service. Ticking the box will be deemed to have the same value as a handwritten signature by the Customer.
  • STEP 6 – Verification. The Customer must check all the information entered before continuing with the purchase by clicking on the “GO TO SECURE PAYMENT” button.
    Payment information (credit card number) must be entered by the Customer, it being specified that said payment information is not collected directly by the Association Route Jacques Cœur but by the banking service provider.

Once the payment details have been entered, the Customer must validate by clicking on the “Validate” button.

  • STEP 7 – Order receipt. The customer is informed that the payment has been taken into account and that the order has been validated. A reservation reference is assigned.
    The Customer receives an e-mail with a summary of his/her Order (booking reference, Customer details, order details, contact). The Ticket purchased by the Customer is attached to this e-mail.

The Order validated by the Customer will be considered firm and definitive for the Customer once the authorized partner establishments have sent their acceptance. In the event of their refusal, the Order will be automatically cancelled.

In particular, the Association Route Jacques Cœur reserves the right to refuse to validate any Order from a Customer who has not paid in full or in part for a previous Order, or with whom a payment dispute is being processed.

Article 5. Right of withdrawal

5.1. Definition

Within the meaning of article L.221-1 of the French Consumer Code, a “distance contract” is any contract concluded between the Company and a Customer, as part of an organized system of distance sales or provision of services, without the simultaneous physical presence of the professional and the consumer, by the exclusive use of one or more distance communication techniques, such as letter sent by post, fax, e-mail or text message, until the conclusion of the contract.

5.2. Right of withdrawal

In the case of distance selling, the Customer has the right to withdraw from the contract without giving any reason within fourteen (14) days of validation of the Order, for contracts for the provision of services.

To exercise his right of withdrawal, the Customer must notify the Association Route Jacques Cœur of his decision to withdraw by means of an unambiguous statement (e.g. letter sent by post, fax or e-mail). The Customer may, but is not obliged to, use the model withdrawal form attached as Appendix 1. For the withdrawal period to be respected, it is sufficient to transmit the communication relating to the exercise of the right of withdrawal before the expiry of the withdrawal period.

5.3. Effects of withdrawal

In the event of the Customer exercising his right of withdrawal, the Association Route Jacques Cœur will reimburse all payments received from him without undue delay and, in any event, within fourteen (14) days of receipt of the decision to withdraw. The Association Route Jacques Cœur will make the refund using the same means of payment as the one used by the Customer on the day of payment of the deposit or the balance, unless the Parties expressly agree on a different means. In any event, this refund will not incur any costs for the Customer.

Article 6. Cancellation of an Order

6.1. Order cancellation/modification by the Customer

Once the Order has been validated by the Customer, the Customer may not cancel it. Consequently, in the event of withdrawal, refusal or cancellation by the Customer, the Association Route Jacques Cœur shall be released from all contractual obligations towards the Customer and the latter may not claim either the postponement of his/her Ticket to another date, or the reimbursement of the price paid and retained by the Association Route Jacques Cœur as irreducible contractual termination indemnity.

6.2. Cancellation/Modification of Order by the Association Route Jacques Cœur

In addition to the conditions of non-acceptance/refusal of an Order as set out in article 4, the Association Route Jacques Cœur may cancel an Order under the following conditions:

The Association Route Jacques Cœur may, at any time, for safety reasons, due to weather conditions or any case of Force Majeure, modify the Event, modify the Activities and/or the day of the Event. Such changes shall not incur the liability of the Association Route Jacques Cœur, nor constitute compensable damages for the Customer.

The Association Route Jacques Cœur may cancel a Service, Activity or Event at any time, including at the place and on the day scheduled for the Event, for any legitimate reason and/or in the event of force majeure. Legitimate reasons for cancellation of the Prestation and/or Activity and/or Event (to be assessed by the Association Route Jacques Cœur) include: adverse weather conditions, security conditions, social unrest affecting the event location, energy shortages, changes in applicable regulations or legislation, particularly in relation to the COVID 19 pandemic or anti-terrorism measures. In such a case, the customer may choose (on the proposal of the Route Jacques Cœur Association) and except in the case of imperative provisions to the contrary, between :

  • either cancel the Order and be reimbursed for the price paid for it;
  • or be offered another Service at an equivalent price, or another Ticket date as agreed between the Parties.

In any event, the Association Route Jacques Cœur cannot be held responsible for any cancellation or modification of the initially agreed Service and/or Event, due to the reasons given in this article 6.2. No reimbursement of costs incurred by the Customer – other than the price of the Order – will be made (in the event of cancellation).

6.3. Specific cancellations

6.3.1 Cancellation of “Crime au Château” events

The Association Route Jacques Cœur reserves the right to cancel or postpone the Event if :

  • the minimum number of participants is not reached without compensation or penalty due to the customer. In this case, participants will be notified at least 24 hours before the date and may be registered for a later session;
  • if the health situation so requires;
  • if weather conditions hinder the smooth running of the Event.
    The Association Route Jacques Cœur reserves the right to change the venue indicated in the invitation e-mail.

Any postponement at the Customer’s initiative must be notified at least 48 hours before the date of the Event by e-mail to contact@routejacquescoeur.fr or by post to Route Jacques Cœur Place Simone Veil 18000 Bourges, as evidenced by the postmark.

Cancellations made by post or e-mail must be received no later than 48 hours before the date of the Event by e-mail to contact@routejacquescoeur.fr or by post to Route Jacques Cœur Place Simone Veil 18000 Bourges, date as postmark. Otherwise, all sums paid by the customer will be forfeited.

6.4.1 Cancellation of guided tours

The Organizer of the guided tour, a member of the Route Jacques Cœur Association, reserves the right to cancel or postpone a session if the maximum number of Participants (10) is reached. In this case, Participants registered for the guided tour of the site will be notified at least 24 hours before the date by e-mail and/or telephone. Participants may be registered for a later session. The Route Jacques Cœur Association cannot be held responsible for any cancellation or postponement of the guided tour.

6.5.1 Cancellation of “Ateliers du Patrimoine Ville et Pays d’Art et d’Histoire de Bourges” (Bourges Heritage Workshops)

If the Workshops are cancelled by the Ville d’Art et d’Histoire Organizer, the Route Jacques Cœur Association undertakes to refund tickets to users if the workshop cannot take place (e.g. due to the instructor’s illness, or bad weather preventing outdoor activities).

If the Workshop is cancelled by the Customer, only two cases of cancellation may give rise to a refund: the person due to take part in the Workshop is ill (on presentation of a valid medical certificate stating the name of the person), or the person has moved house. The Ville d’Art et d’Histoire will deal with cancellations from customers on a case-by-case basis, and if necessary, the Association Route Jacques Cœur will reimburse the tickets by bank transfer upon receipt of the customer’s bank details.

Article 7. Services

The Customer may choose between several types of Tickets: Privilege Pass Tickets, Tickets for year-round admission to certain members and Tickets giving access to temporary events.

The customer must also select the quantity of Tickets required.

1. For Privilege Pass Tickets
This Ticket offered by the Route Jacques Cœur Association is a digitalized loyalty card as detailed below:

1.1 Content of the Service

When the Customer orders the Pass Privilège for the amount of €6 on the https://route-jacques-coeur.com/ website, he/she benefits from price reductions of €1 to €5 on all the visits and activities offered by the Members and Partners of the Route Jacques Cœur Association detailed below.

In 2025, customers can use their Privilege Pass at :

  • the 21 Member sites of the Route Jacques Cœur Association: Château de la Chapelle d’Angillon – Musée Alain Fournier, Château de Meillant, Château de Menetou-Salon, Château et jardins de Peufeilhoux, Château et parc de Pesselières, Château d’Ainay-le-Vieil, Château de Sagonne, Château-Musée de Gien, Château de La Verrerie, Domaine de Châteaufer, Abbaye de Noirlac, Cathédrale de Jean Linard, Galerie Capazza, Palais Jacques Cœur, Ville d’Aubigny-sur-Nère, Ville d’Argent-sur-Sauldre, Ville de Bourges, Ville de Mehun-sur-Yèvre, Ville de Saint-Amand-Montrond, Ville de Sancerre (except the Ville de Dun-sur-Auron, which does not offer paying services).
  • the 11 partner sites of the Route Jacques Cœur Association: Château de Boucard, Château de Buranlure, Château de Maupas, Crypt of Bourges Cathedral, Hôtel de Panette, Maison des Sancerre, Musée Émile Chénon, Prieuré d’Allichamps, Street Art City, Tour de Vesvre, Village de La Celle.

1.2 Conditions of use

The Privilege Pass Ticket is received by the customer by e-mail, in the form of a ticket with a bar code, usable for one year from the date of purchase shown on the Ticket. The Ticket is nominative, and when the Customer presents it at the Member or Partner reception desk to benefit from the reduced rate applicable to the Privilege Pass holder, he/she must show proof of identity.

2. For year-round entry tickets for certain members
These Tickets, offered by the Route Jacques Cœur Association, enable the purchase of admission to certain Association member sites.

In 2025, the Tickets on the https://route-jacques-coeur.com/ website will give access to Jean Linard’s Cathedral.

2.1 Content of the Service

When the Customer orders a Ticket on the https://route-jacques-coeur.com/ website, he/she must choose a day of visit from among the Member’s opening days. Once the Order has been placed on the website, the Customer receives an e-mail with his Tickets.

2.2 Conditions of use

In order to use the Ticket, the Customer must go to the entrance of the Monument reserved on the day indicated on the Ticket. As the Ticket is nominative, the Customer must show proof of identity on site for the Ticket to be validated.

3. For Tickets giving access to temporary events
These Tickets, offered by the Route Jacques Cœur Association, are used to purchase admission to certain events organized by members of the Association.

In 2025, several events are marketed on the https://route-jacques-coeur.com/ website, such as the Crimes au château and the Fêtes Médiévales de Sagonne.

3.1 Content of the Event

When the Customer orders a Ticket on the https://route-jacques-coeur.com/ website, he/she must choose a day of visit from among those proposed for the event, if the latter extends over several dates. Once the Order has been placed on the website, the Customer receives an e-mail with his/her Tickets.

3.2 Conditions of use

In order to use the Ticket, the Customer must go to the entrance of the Monument reserved on the day indicated on the Ticket. As the Ticket is nominative, the Customer must show proof of identity on site for the Ticket to be validated.

Article 8. Obligations of the Association Route Jacques Cœur

The Association Route Jacques Cœur undertakes to communicate with its Members in order to provide them with all information relating to Orders placed by Customers.
The Association Route Jacques Cœur undertakes not to divulge any information provided by the Customer, which will be treated as confidential. Any information gathered within the framework of the Service may be communicated to Members and Partners, who will be bound by the same rules of confidentiality.

Article 9. Customer obligations

The Customer undertakes to keep his/her Ticket once it has been received by e-mail, in order to present it on D-Day at the Monument reception desk.
The Customer also undertakes to comply with current regulations, in particular those relating to the Covid 19 pandemic. Customers taking part in activities, visits and/or events undertake to comply with current barrier measures as far as possible.
All online registrations and reservations imply acceptance of these conditions. Upon presentation at the site reception desk, the Customer must be able to show a printed Ticket or one on his/her cell phone. Customers must also be able to show proof of age if they are presenting a Ticket with a reduced rate (student card, job-seeker’s card, Pass Privilège Jacques Cœur, identity card for age-related reduced rate, proof of purchase).

Customers taking part in activities, visits and/or events declare that they will not hold the Association Route Jacques Cœur or the Members or Partners of the activity responsible for any damage caused to others by excessive alcohol consumption. The Route Jacques Cœur Association encourages participants not to drink too much alcohol during the “verre de l’amitié” which may be offered at the end of the event.

Article 10. Prices

10.1. Price determination

The Services are provided at the current prices set by the Association Route Jacques Cœur and the Members on the Website. Prices may also be modified at any time by the Association Route Jacques Cœur and the Members prior to validation of the Order. The prices applied will be those indicated on the Website at the time the Order is validated.

Prices are displayed exclusive of VAT. The VAT applicable will be that in force on the date of the Order, and any change in the applicable VAT rate will automatically be reflected in the price of the Services on the date of invoicing.

All prices are inclusive of the Services offered by the Route Jacques Cœur Association and its Members, and vary according to the Service chosen by the Customer.

The full price of the Service will be paid by the Customer when the Order is placed and will give rise to its validation. The Customer therefore undertakes to pay cash in advance for the Service at the time of placing the Order.

10.2. Payment – Terms and conditions

All Orders placed are Orders subject to payment, which means that placing an Order implies payment by the Customer.

By placing an Order, the Customer undertakes to pay the full price of the Service, the amount of which is indicated on the Web Site.

In the case of an online Order, payment of the price will be made online in euros by credit card (CB, VISA, MasterCard), using the bank details provided to the Company.

The Customer’s bank details (credit card number and expiry date) are encrypted and then processed by our banking partners. The banking establishments are solely responsible for processing the personal banking Data entered by the Customer relating to the means of payment. The Customer guarantees that he/she is fully authorized to use the payment card and that this card gives access to sufficient funds to cover the costs of the order, and undertakes to provide these establishments with accurate information. The Association Route Jacques Cœur cannot be held responsible for an order recorded and paid for using information belonging to the customer and held by a third party.

Payment must be made as soon as the Service is booked on the website, at least one (1) day before the date of participation in the activities, visits and/or events indicated on the Ticket.

The Customer guarantees that he/she is fully authorized to use the means of payment he/she uses, and that these means of payment provide access to sufficient funds to cover the costs of the Order. The Customer must indicate the Order reference number when making payment.

Payments (other than by credit card) must be sent to the Association Route Jacques Cœur within the time limits mentioned in the present article. All payments by bank transfer must be made to the Route Jacques Cœur Association’s bank account, details of which are as follows:

The Association Route Jacques Cœur reserves the right to suspend any Order and/or any Service in the event of refusal to authorize payment by banking institutions or in the event of non-payment.

Under no circumstances may payments due to the Association Route Jacques Cœur be suspended or be subject to any reduction or compensation without the prior written agreement of the Association Route Jacques Cœur. Any payment made to the Association Route Jacques Cœur will be deducted from the sums due, whatever the cause, starting with those which are the earliest to fall due.

10.3 Late payment and penalties

Any sum not paid by the due date shown on the invoice will automatically result in the immediate payment of the remaining sums due and the application of interest on arrears equal to the legal interest rate in force, from the date of formal notice for payment.

Article 11. Bloctel

The consumer Customer may register free of charge on a BLOCTEL(www.bloctel.gouv.fr) telephone anti-solicitation list, in order to avoid being canvassed by telephone. Any Customer can register free of charge on this list at https://www.bloctel.gouv.fr/inscription.

Article 12. Intellectual property rights

The Website is the property of the Association Route Jacques Cœur or is lawfully exploited by the latter.

All rights relating to the Website and to the overall concept of the activities of the Association Route Jacques Cœur (in particular, but not exhaustively, intellectual property rights over texts, literary and artistic creations, graphics (including photographs) and audiovisual works, computer developments, HTML developments and other intellectual works and, more generally, all creations likely to be protected by intellectual property law, such as images, logos, etc.) are the property of the Association Route Jacques Cœur, the layout, the graphic charter, the structure, the ergonomics, the color codes, the typographies, the fonts, the basic graphic elements, the graphic organization of the screens, the page layout, the page backgrounds, the visual identity of the Website, the sound elements or the brands), to the overall concept of the activity of the Association Route Jacques Cœur and to their original and innovative character belong to the Association Route Jacques Cœur or are regularly exploited by the latter, without any limitation.

The Association Route Jacques Cœur also retains all industrial and intellectual property rights relating to the Deliverables, trademarks, drawings and models, photos and catalogs.

Any imitation or reproduction, in whole or in part, of the aforementioned rights, on any medium whatsoever, is strictly forbidden. Any reproduction or use of the Route Jacques Cœur Association’s intellectual property rights by the Customer may be prosecuted.

Article 13. Liability

The Customer is solely responsible for the information and Personal Data he/she provides. It is reminded that the provision of erroneous or inaccurate information which has made it impossible for the Association Route Jacques Cœur to fulfil its obligations, in particular, to provide the Services, shall not incur the liability of the latter as a result.

Equipment (computers, smartphones, tablets, software, telecommunications, etc.) used to access the Website and/or to place Orders by telephone are the sole responsibility of the Customer, as are any telecommunications costs incurred by their use.

Customers acknowledge and accept that no one can guarantee the proper functioning of the Internet as a whole. In the event of inability to access or malfunction of the Website, due in particular to technical problems or problems of any kind, Customers may not claim any damages or compensation.

In all cases, the Association Route Jacques Cœur may only be held liable, where applicable, for damages directly related to the performance of the service contract and its consequences, provided that such damages result from a fault attributable to the Association Route Jacques Cœur in the performance of said contract.

The Association Route Jacques Cœur is in no way responsible for any damage, direct or indirect, caused by the Customer on the websites of Members and Partners.

Nor is the Association Route Jacques Cœur liable for any direct or indirect prejudice linked to the performance or non-performance of the services provided by the Partner Provider(s), in particular on the day on which the Service is provided.

For Tickets sold on behalf of Providers, the Association Route Jacques Cœur is a platform for bringing together Customers and Providers, and does not intervene in their relationship, whatever it may be. It declines all responsibility in the event of a dispute between a Customer and a Provider, whatever the basis and cause. The User is subject to compliance with the Provider’s general terms and conditions of sale, which he/she will have accepted online before making his/her reservation. The Association Route Jacques Cœur makes no commitment concerning the quality of the services provided by the Service Providers. Sales are made directly between the Customer and the Service Provider.

Article 14. Insurance

The Customer is informed that the Association Route Jacques Cœur holds professional liability insurance with AXA under the number: 0031877900152587.

Article 15. Force majeure

The Association Route Jacques Cœur may not be held responsible for the non-performance of the contract in the event of force majeure, namely in the event of a strike, notably of the postal services and means of communication, flood, fire, or any unfavorable weather conditions, legislation or emergency decision, confinement measures, requisition, or cut-off of means of telecommunication.

Article 16. Personal data

Within the framework of the Contract, the Association Route Jacques Cœur undertakes to comply with the regulations in force applicable to the processing of personal data and, in particular, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 applicable from 25 May 2018 (“European Data Protection Regulation”), but also the French Data Protection Act no. 78-17 of 6 January 1978 regularly amended (“Data Protection Act”) and together (“Personal Data Regulations”).

The use of the Website, the Ordering of Services and the execution of the latter require the collection, by the Association Route Jacques Cœur, of a certain amount of personal information concerning the Customer: title, surname, first name, telephone number, e-mail address, postal address. The Association Route Jacques Cœur is considered to be responsible for the processing of this personal data in connection with the use of the Website and the provision of Services.

This data is kept for a reasonable period necessary for the proper administration and execution of the Orders and for the duration of the legal statute of limitations applicable to the present Contract.

This data is transmitted exclusively to persons who need to know it, i.e. Service Providers, Members and Partners, technical services, consultants and potential investors.

A certain amount of personal data may be collected by the Association Route Jacques Cœur in order to ensure the proper performance of the Services provided by the Providers. In this case, the Association Route Jacques Cœur will act as a subcontractor for the Service Providers within the meaning of the Personal Data Regulations. The Association Route Jacques Cœur will transmit this data directly to the Service Providers concerned.

As a matter of principle, no personal data is transmitted outside the European Union, or if this is the case, such data will be transmitted in compliance with European regulations.

Customers are reminded that every person has the right to request access to, rectification or deletion of data concerning him or her, as well as limitation of processing when deletion is not possible, and the right to object to the processing of his or her data and the right to data portability. Every individual is also entitled to lodge a complaint with the CNIL, and has the right to define directives concerning the fate of his or her personal data after death.

No automated decisions are made on the basis of data collected in this way.

Customers who do not wish to provide the information required to place Orders will not be able to place Orders or receive newsletters.

With the exception of data relating to means of payment, the Association Route Jacques Cœur is responsible for processing or subcontracting, depending on the data processed, under the conditions set out in the Privacy Policy accessible on the https://route-jacques-coeur.com/ website, in the “Legal information” section.

Customers who communicate Participant data must ensure that they have the right to communicate such information.

Article 17. Cookies

The Website uses cookies. The use of Cookies is defined in the Cookies Management Policy of the Association Route Jacques Cœur accessible on the Website: https: //route-jacques-coeur.com/, in the “Legal Notice” section.

Cookies requiring prior information and consent are, for example, social network cookies generated by social network sharing buttons when they collect personal data without the consent of the persons concerned.

Article 18. Archiving

All orders will be archived by the Association Route Jacques Cœur for a period of ten years (article 1127-1 of the French Civil Code and L.213-1 of the French Consumer Code). To access the archived orders to which he/she has subscribed, the Customer must send a request to the Association Route Jacques Cœur by post or e-mail (contact details at the top of this document).

Article 19. General provisions

Should any of the stipulations of the present general terms and conditions prove to be null and void, in particular with regard to a rule of law or a judicial decision that has become definitive, the stipulation will then be deemed unwritten, without affecting the validity and binding force of the other stipulations. The fact that one or other of the Parties does not avail itself, at a given time, of any of the clauses of the present GCS, shall not constitute a waiver by said Party of its right to avail itself of said clause at a later date.

Nothing in these GTS is intended to create a relationship of subordination and/or joint venture between the Parties. Accordingly, neither Party is authorized to enter into any commitment or negotiate on behalf of the other Party, or even commit the other Party, without the express prior consent of the other Party.

Any notification made in application of these GCS shall be sent by registered letter with acknowledgement of receipt and/or extrajudicial document to the respective domicile or registered office of each of the Parties. Notifications shall be deemed to have been made on the date of the postmark.

Article 20. Applicable law and disputes

These GCS and the contractual relations arising therefrom are governed exclusively by French law.

In the event of a claim or dispute, the Customer must contact the Association Route Jacques Cœur and inform it of any comments and/or complaints. In the absence of a satisfactory solution, the Customer may, if he/she so wishes, in accordance with articles L.611-1 et seq. of the French Consumer Code, have recourse to a consumer mediator.

A dispute cannot be examined by the consumer mediator when :

  • The customer does not justify having previously attempted to resolve the dispute directly with the Association Route Jacques Cœur by means of a written complaint including the following elements (order validation, invoice, precise and detailed description of the complaint);
  • The claim is manifestly unfounded or abusive;
  • The dispute has already been or is being examined by another mediator or by a court;
  • The customer lodged his request with the mediator more than one year after his written complaint to the professional;
  • The dispute does not fall within the mediator’s jurisdiction.

The customer must inform the Route Jacques Cœur Association of this request without delay.

In addition, the European Commission also provides consumers with an online dispute resolution platform, which the Customer would have with the Association Route Jacques Cœur, which the consumer can access directly by clicking on the link: https: //ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=FR.
